Terms of Sale

1. Purpose and scope
These Terms of Sale (hereinafter the “Terms of Sale”) govern the collection, transport, breakdown recovery and towing of motor vehicles offered by Ahmed HAJJAJI, a sole trader operating under the trading name SkyRoute Auto (SIREN 880 853 890 — 880 853 890 R.C.S. Thonon-les-Bains), whose establishment is at 74 bis Route d’Étrembières, 74100 Annemasse, France (hereinafter the “Provider”).
They apply to any order placed by a private customer (consumer) or a business customer (hereinafter the “Customer”), unless special written terms are accepted by both parties. Any order implies full and complete acceptance of these Terms of Sale.
2. Services
The Provider in particular offers:
- recovery of a broken-down vehicle (including battery);
- towing and transport of a drivable, non-drivable, accident-damaged or immobilised vehicle;
- short- / long-distance repatriation;
- vehicle delivery / collection;
- transport to a garage, dealership, body shop or MOT centre;
- France ↔ Switzerland transport and delivery linked to customs formalities;
- call-outs in difficult access (underground car park, snow, mountains, etc.) according to equipment and feasibility.
Services are performed by appointment / subject to availability, including at night, weekends and bank holidays, within the Provider’s means.
3. Motorways and express roads
In accordance with applicable regulations, on motorways and express roads, the initial recovery of the vehicle is carried out by the designated approved recovery service — typically via an SOS phone or 112. Additional routing may go through the network presented on sos-auto-moto.fr (dispatch). SkyRoute Auto then, where applicable, handles repatriation or transport of the vehicle to the agreed destination, after a quote and acceptance. See the Motorway procedure page.
4. Quote, order and formation of the contract
- The Customer provides the necessary information: collection location, destination, make/model, condition of the vehicle, access, contact details, and photographs where applicable.
- An indicative quote is given orally and/or in writing (SMS, email, messaging). Unless otherwise stated, the quote is valid for 24 hours or until the stated call-out time for emergencies.
- The contract is formed upon clear acceptance of the quote by the Customer (confirmed orally, in writing, or expressly authorised start of the call-out).
- Any change to the route, the condition of the vehicle or access conditions may lead to an adjustment of the price, communicated before the service continues where possible.
A request via the website form does not constitute automatic acceptance. The Provider may refuse a job for a legitimate reason (safety, technical impossibility, area not covered, unavailability, insufficient information, non-payment of a previous service, etc.).
5. Customer obligations
The Customer undertakes to:
- provide accurate and complete information;
- warrant that they own the vehicle or are duly authorised to dispose of it;
- report any hazard (leak, fire risk, load, etc.);
- ensure reasonable access to the vehicle (keys, car-park badges, authorisations);
- remove or secure valuables; the Provider is not a depositary of personal effects;
- pay the price on the agreed terms.
6. Provider obligations
The Provider performs the service with due care, as a professional in the sector, with suitable equipment where the job requires it (approved trailer, strapping, 4x4 as the case may be). It informs the Customer of difficulties encountered and of possible alternatives.
Call-out times are indicative and depend on traffic, weather, access and availability. No firm timescale is guaranteed unless otherwise agreed in writing.
7. Prices and payment
Prices are quoted in euros (and/or Swiss francs if agreed), excluding any ancillary charges clearly stated (tolls, parking, prolonged waiting, empty running, night/weekend surcharge, difficult access, etc.).
Unless otherwise agreed in writing, payment is due at the end of the service (cash within legal limits, card, bank transfer, or another accepted method). For businesses, a payment term may be agreed; failing that, payment is due immediately.
Any late payment may give rise to interest at the applicable statutory rate and, for business Customers, the fixed recovery indemnity provided for by the French Commercial Code (amount in force).
8. Cancellation
- By the Customer: any cancellation after the Provider has set off may give rise to billing of travel / mobilisation costs already incurred.
- By the Provider: in the event of impossibility (force majeure, safety, equipment breakdown, obvious error as to the condition of the vehicle), the Customer is informed as soon as possible; sums unduly received are refunded, excluding costs already justified.
9. Right of withdrawal (consumers)
In accordance with articles L.221-18 et seq. of the French Consumer Code, the 14-day right of withdrawal applicable to distance contracts does not apply to services fully performed before the end of the withdrawal period and whose performance began after the consumer’s express prior agreement and express waiver of the right of withdrawal (art. L.221-28). Emergency call-outs / jobs on an accepted quote then performed immediately generally fall within this framework.
Where the service has not yet begun, the consumer Customer may cancel under article 8.
10. Liability and insurance
The Provider is liable under ordinary law, limited to foreseeable damage linked to the service, except in cases of gross or wilful misconduct. It is not liable for damage resulting from: a pre-existing condition of the vehicle, misleading access, a prior incident, undeclared items, force majeure, or the act of the Customer / a third party.
The Customer remains responsible for their own insurance (motor, roadside assistance). Any reservation as to the condition of the vehicle must be reported at the time of return or, failing that, within a reasonable time in writing with supporting evidence.
The Provider declares that it carries on its activity in compliance with the legal obligations applicable to carriers / assistance according to the exact nature of each job. Insurance certificates may be provided on justified request.
11. Force majeure
Events beyond the Provider’s reasonable control (exceptional weather, disasters, blocking strikes, administrative prohibitions, accidents preventing access, etc.) are treated as force majeure. Obligations are suspended for the duration of the event.
12. Personal data
Data collected for the job (identity, telephone, locations, vehicle) are processed for performance of the contract and legal obligations. See the Privacy policy.
13. Consumer mediation
In accordance with articles L.611-1 et seq. and R.612-1 et seq. of the French Consumer Code, the consumer Customer may free of charge refer a dispute with the Provider to a consumer mediator with a view to an amicable resolution, after attempting to resolve the dispute directly with SkyRoute Auto by written complaint (contact@skyroute-74.fr).
Appointment in progress: the named contact details of the mediator will be published here once affiliation is finalised; they are also provided on simple request to contact@skyroute-74.fr. In the meantime, the consumer Customer may use the European online dispute resolution platform: ec.europa.eu/consumers/odr.

15. Governing law and jurisdiction
These Terms of Sale are governed by French law. For business Customers, jurisdiction is conferred on the courts of the Provider’s registered office, unless mandatory rules provide otherwise. For consumers, the protective jurisdiction rules of the Consumer Code and the Code of Civil Procedure apply.
16. General provisions
If a clause of the Terms of Sale is held to be void, the others remain applicable. Failure to rely on a breach does not constitute a waiver. The applicable Terms of Sale are those in force on the date the contract is formed (published update: 12 August 2026).
